General Terms & Conditions of Online Sale
ARTICLE 1. OUR COMMERCIAL POLICY
Bonpoint offers products for sale on the Website (hereinafter the “Website”), conducting its own e-commerce business and exclusively targeting end users, hereinafter referred to as the “Customer.”
“Bonpoint” refers to Bonpoint Rive Droite, a simplified joint-stock company, registered under number 348 890 476 R.C.S. Paris, with its registered office at 62 avenue d’Iéna, 75116 PARIS.
“Customer” means any natural person not acting for professional purposes or in connection with a business activity. Considering the above commercial policy, the Website reserves the right not to process orders from parties other than the Customer as defined above or orders not in conformity with its commercial policy.
These General Terms and Conditions of Sale (hereinafter the “GTCs”) exclusively govern all online sales conducted via the Website, to the exclusion of any other documents, including terms applicable to in-store sales or via other distribution or marketing channels.
By placing an order for a Product on the Website, the Customer acknowledges having read and accepted the GTCs without restriction; such acceptance is not conditional upon a handwritten signature. Browsing the Website is also governed by the Legal Notice, which the Customer accepts without reservation and which is accessible at https://www.bonpoint.com/en-eu/pages/legal-notice . The Customer may save or print the GTCs, provided they are not modified. Bonpoint reserves the right to update the GTCs at any time, particularly in light of regulatory changes. In such cases, the new version will apply from the date of publication on the Website. The date of the latest update is indicated at the bottom of the page.
ARTICLE 2. PURCHASING ON THE BONPOINT E-BOUTIQUE
The order form contains all essential information for the order, including product prices (including applicable taxes), payment methods, available delivery options, and applicable delivery charges for each product.
Products offered for sale are those displayed on the Website at the time of the Customer’s visit, subject to stock availability.
Great care is taken in the presentation of Products on the Website to comply with Article L.111-1 of the French Consumer Code. Products are presented through detailed information sheets prepared meticulously by professional experts to provide the most accurate and complete descriptions. However, due to the digital presentation of Products online, including technical limitations in color rendering on computer equipment, the monitor used, or browser effects, the perception of materials or colors may vary.
Before purchasing Products via the order form, Customers are asked to carefully read the GTCs. They are also required to detect and correct any data entry errors before submitting the form.
Once the contract is concluded, Bonpoint will process the order.
The order form will be archived in our database for the time necessary to dispatch orders and in accordance with statutory deadlines. Customers may access their order forms via the “Your Account / Your Orders” section.
Products are offered while stocks last. Any stock information on the Website is indicative only, to the extent technically feasible. If a Product is unavailable, the Customer will be notified by email as soon as possible, and either the order will be partially fulfilled or canceled. Any order for an unavailable Product that has already been paid for will only give rise to a refund of the Product and any applicable delivery charges, with no further compensation.
Products are not intended for resale.
ARTICLE 3. INFORMATION RELATING TO PRODUCTS
Only luxury and top-quality branded products are offered for sale on the Website. These products are purchased directly by Bonpoint from fashion houses, producers, and resellers carefully selected for their rigorous quality controls.
Bonpoint does not sell second-hand, defective, or substandard products.
Product prices are firm. The applicable price is the one indicated on the corresponding product pages on the Website, except in case of typographical errors. Prices include VAT applicable on the order date. Packaging and delivery charges may be invoiced in addition, and if so, will be specified to the Customer during the ordering process. These charges are fixed and non-negotiable.
Bonpoint reserves the right, which the Customer accepts, to modify prices at any time by updating them on the Website. Such changes do not affect orders already accepted, subject to product availability.
All Products carry an identification tag. Customers are requested not to remove the tag or the single-use seal in case of returns.
Products returned without the tag, or altered in their essential characteristics or damaged, may be refused by Bonpoint in the exercise of the right of withdrawal.
Payment may be made in full or in part using a Bonpoint Gift Card. The Gift Card is valid for one year from the date of purchase, usable on bonpoint.com and in Bonpoint boutiques in the country of issue, excluding department stores and outlets. It can be used once or multiple times up to its value, supplemented by another payment method if needed. Gift Cards cannot be redeemed for cash, used to purchase other Gift Cards, or exchanged/refunded in any circumstance, including loss, theft, damage, or expiration.
ARTICLE 4. ORDERING PROCESS
Customers may freely browse the Website to view Products without obligation to place an order.
Orders can be recorded:
- If the Customer has previously logged in using personal credentials, at the delivery stage;
- By creating a Customer account.
During the first order, the Customer must select a username (email address) and password to personalize their visit. Additional information necessary for processing and executing the order must also be provided.
At each subsequent visit, Customers may log in with their credentials, which serve as proof of identity. Customers are responsible for their username and password. Lost passwords can be reset via the “Forgot Password” function.
Information provided by Customers is treated confidentially and stored in Bonpoint’s database. It will not be shared with third parties except as required by law or as stated in the Website’s Privacy Policy.
To place an order, Customers add Products to the cart and proceed to the “Delivery” step to provide billing and shipping information.
Before finalizing the order by clicking “Confirm my Order” and making payment, Customers may verify the order details and correct errors.
The Customer must check the box “I have read and accepted the General Terms and Conditions” to finalize the order before choosing the payment method.
The sale is final only after Bonpoint sends an order confirmation email. This email summarizes the order reference number, Products ordered, prices, delivery terms, and withdrawal instructions, as well as contact information for Customer Service.
ARTICLE 5. PAYMENT
Payment terms are indicated on the order form.
Credit/debit card information is transmitted via encrypted protocol to the chosen payment partner (ADYEN, PAYPAL, or other banks providing electronic payment services), and cannot be accessed by third parties. Such information is only used for processing the purchase or issuing refunds.
Payments are secured with 3D Secure, which requires a one-time code sent via SMS. Payment validation by the bank occurs only after entering this code. Bonpoint does not retain bank details. Data transmissions to banks are encrypted.
The purchase price and delivery charges are debited from the Customer’s account at the time of purchase.
Cheque payments are not accepted.
Bonpoint reserves the right to refuse orders or delivery in case of credit limits, disputes, non-payment, or declined bank authorizations. The Customer guarantees the authorization to use the chosen payment method. In case of bank refusal, the order is automatically canceled.
Order records are maintained in Bonpoint and its partner bank’s IT systems, serving as evidence of transactions. The Website is secured, and cryptographic methods used comply with current legislation.
